Estos Términos y Condiciones ("Términos") rigen el uso del sitio web, la plataforma de cursos, las clases en vivo, las membresías y los servicios ofrecidos por Instituto Adela Vargas LLC ("nosotros", "nuestro" o el "Instituto"). Al acceder o utilizar nuestros servicios, usted acepta estos Términos en su totalidad. Si no está de acuerdo, no utilice nuestros servicios.

1. Elegibilidad

Debe tener al menos 18 años de edad y capacidad legal para celebrar contratos vinculantes para usar nuestros servicios y realizar una compra.

2. Cuentas y seguridad

Para acceder a los cursos y clases en vivo debe crear una cuenta. Usted es responsable de mantener la confidencialidad de sus credenciales y de toda actividad realizada bajo su cuenta. Utilizamos códigos de verificación de un solo uso (OTP) enviados por correo electrónico o SMS para verificar su identidad al iniciar sesión y al acceder a las clases en vivo. Usted acepta no compartir dichos códigos con terceros.

3. Membresía, precios y pagos

  • La membresía se ofrece en planes anuales y, cuando esté disponible, mensuales. El precio vigente se muestra en el momento de la compra.
  • Los pagos con tarjeta se procesan de forma segura a través de Square. También aceptamos determinados pagos fuera de tarjeta (por ejemplo, ACH, Zelle, Venmo) según lo coordinado con nuestro equipo.
  • Al comprar, usted autoriza el cargo por el monto indicado. Las membresías otorgan acceso durante el período contratado a partir de la fecha de provisión.
  • Usted es responsable de que la información de pago sea correcta y esté vigente.

4. Reembolsos y cancelación

Puede cancelar su membresía en cualquier momento; la cancelación detiene renovaciones futuras y el acceso continúa hasta el final del período ya pagado. Las solicitudes de reembolso se evalúan de acuerdo con la política vigente al momento de la compra; salvo que la ley disponga lo contrario o se indique expresamente, los productos digitales y el acceso ya otorgado no son reembolsables. 5. Programa de mensajes de texto (SMS)

Al optar por participar, usted acepta recibir mensajes de texto (SMS) de Instituto Adela Vargas LLC relacionados con: actualizaciones de su membresía, recordatorios de lecciones y clases programadas, contraseñas y códigos de verificación de un solo uso (OTP), y verificación para acceder a las clases en vivo.

  • La frecuencia de los mensajes varía. Pueden aplicarse tarifas de mensajes y datos.
  • Responda STOP en cualquier momento para cancelar la suscripción; responda HELP (AYUDA) para obtener asistencia.
  • El consentimiento para recibir SMS no es una condición de compra de ningún bien o servicio.

6. Propiedad intelectual y licencia de uso

Todo el contenido de los cursos, videos, materiales descargables, textos, marcas y logotipos son propiedad de Instituto Adela Vargas LLC o de sus licenciantes y están protegidos por las leyes de propiedad intelectual. Le otorgamos una licencia personal, limitada, no exclusiva e intransferible para acceder al contenido con fines educativos propios durante su membresía. Queda prohibido copiar, redistribuir, revender, grabar, transmitir públicamente o compartir el contenido o sus credenciales de acceso.

7. Uso aceptable

Usted se compromete a no utilizar los servicios de forma ilegal, a no intentar vulnerar la seguridad de la plataforma, ni a interferir con el funcionamiento del servicio o la experiencia de otros usuarios. Podemos suspender o cancelar el acceso ante incumplimientos de estos Términos.

8. Aviso sobre asesoría de inversión

El contenido educativo del Instituto sobre inversión en bienes raíces se ofrece únicamente con fines informativos y educativos. No constituye asesoría financiera, de inversión, legal ni fiscal, ni una recomendación de compra o venta. Los resultados varían y no garantizamos ganancias ni rendimientos de ningún tipo. Toda decisión de inversión es su responsabilidad; le recomendamos consultar a un profesional debidamente autorizado antes de invertir.

9. Servicios de terceros

Nuestros servicios pueden integrar o enlazar a proveedores externos (por ejemplo, procesamiento de pagos, alojamiento de video y entrega de mensajes). No somos responsables de las prácticas o el contenido de dichos terceros.

10. Descargo de responsabilidad

Los servicios se proporcionan "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas. No garantizamos que el servicio será ininterrumpido o libre de errores.

11. Limitación de responsabilidad

En la máxima medida permitida por la ley, Instituto Adela Vargas LLC no será responsable por daños indirectos, incidentales, especiales o consecuentes derivados del uso de los servicios. Nuestra responsabilidad total no excederá el monto que usted haya pagado en los doce (12) meses anteriores al hecho que dio origen al reclamo.

12. Indemnización

Usted acepta indemnizar y mantener indemne a Instituto Adela Vargas LLC frente a reclamaciones derivadas de su incumplimiento de estos Términos o del uso indebido de los servicios.

13. Ley aplicable

Estos Términos se rigen por las leyes de los Estados Unidos de América y del estado en el que Instituto Adela Vargas LLC está constituida, sin dar efecto a las normas sobre conflicto de leyes.

14. Cambios en los Términos

Podemos modificar estos Términos en cualquier momento. Publicaremos la versión actualizada en esta página con una nueva fecha de "Última actualización". El uso continuado del servicio implica la aceptación de los Términos revisados.

These Terms & Conditions ("Terms") govern your use of the website, course platform, live classes, memberships, and services offered by Instituto Adela Vargas LLC ("we", "us", "our", or the "Institute"). By accessing or using our services, you agree to these Terms in full. If you do not agree, do not use our services.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services and make a purchase.

2. Accounts and Security

To access courses and live classes you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We use one-time verification passcodes (OTP) sent by email or SMS to verify your identity at login and when accessing live classes. You agree not to share these codes with third parties.

3. Membership, Pricing, and Payments

  • Membership is offered in annual and, where available, monthly plans. The applicable price is shown at the time of purchase.
  • Card payments are processed securely through Square. We also accept certain off-card payments (e.g., ACH, Zelle, Venmo) as coordinated with our team.
  • By purchasing, you authorize the charge for the stated amount. Memberships grant access for the contracted period beginning on the provisioning date.
  • You are responsible for keeping your payment information accurate and current.

4. Refunds and Cancellation

You may cancel your membership at any time; cancellation stops future renewals and access continues until the end of the period already paid. Refund requests are evaluated according to the policy in effect at the time of purchase; unless required by law or expressly stated, digital products and access already granted are non-refundable. 5. Text Messaging (SMS) Program

By opting in, you consent to receive text messages (SMS) from Instituto Adela Vargas LLC related to: membership updates, reminders for scheduled lessons and classes, one-time passwords and verification codes (OTP), and verification to access live classes.

  • Message frequency varies. Message and data rates may apply.
  • Reply STOP at any time to opt out; reply HELP for assistance.
  • Consent to receive SMS is not a condition of purchasing any goods or services.

6. Intellectual Property and License

All course content, videos, downloadable materials, text, trademarks, and logos are the property of Instituto Adela Vargas LLC or its licensors and are protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable license to access the content for your own educational purposes during your membership. Copying, redistributing, reselling, recording, publicly transmitting, or sharing the content or your access credentials is prohibited.

7. Acceptable Use

You agree not to use the services unlawfully, not to attempt to breach the security of the platform, and not to interfere with the operation of the service or the experience of other users. We may suspend or terminate access for violations of these Terms.

8. Investment Advice Notice

The Institute's educational content on real estate investing is provided for informational and educational purposes only. It does not constitute financial, investment, legal, or tax advice, nor a recommendation to buy or sell. Results vary and we do not guarantee profits or returns of any kind. All investment decisions are your responsibility; we recommend consulting a duly licensed professional before investing.

9. Third-Party Services

Our services may integrate with or link to external providers (e.g., payment processing, video hosting, and message delivery). We are not responsible for the practices or content of such third parties.

10. Disclaimer

The services are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Instituto Adela Vargas LLC shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the services. Our total liability shall not exceed the amount you paid in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Instituto Adela Vargas LLC against claims arising from your breach of these Terms or misuse of the services.

13. Governing Law

These Terms are governed by the laws of the United States of America and the state in which Instituto Adela Vargas LLC is organized, without giving effect to conflict-of-law rules.
